David A. Roth, a partner in the firm’s Environmental Department, will be on the faculty for the seminar “Discharge Prevention Program: Compliance in New Jersey,” to be presented on May 15, 2018 from 9:00am – 4:30pm. The program will be held at Holly House on the Rutgers’ New Brunswick campus, and is presented by the Rutgers NJAES Office of Continuing Professional Education.
The NJDEP oversees implementation of the Discharges of Petroleum and Other Hazardous Substances (DPHS) rules that impact major facilities throughout the state. As part of these regulations, major facilities are required to prepare, submit and update Discharge Prevention Containment and Countermeasure (DPCC) plans and Discharge Cleanup and Removal (DCR) plans with the NJDEP.
This full-day workshop will cover a comprehensive range of issues elated to these discharges and related compliance issues. Mr. Roth will lecture on court decisions related to liability for these discharges under New Jersey’s Spill Compensation and Control Act (Spill Act). The program agenda includes the following topics:
- Overview of DPHS rules & related State/Federal Programs
- Updates to DPCC and DCR plans
- Requirements for Discharge Notification, Response & Reporting
- Environmentally Sensitive Areas Protection Plan Updates
- NJDEP Procedures for Annual Audits and Post-incident Inspections
- Overview of Administrative Requirements for Remediation of Contaminated Sites and regulation impact on Discharge Prevention Rules
Mr. Roth has over 25 years of experience in the representation of companies, businesses and individuals in a wide variety of complex environmental, health and safety matters. He represents owners/operators, generators and other potentially responsible parties (PRPs) in private and government litigation, cost allocation and other proceedings involving the federal CERCLA (Superfund) statute and the New Jersey Spill Act and other state superfund laws, at federal and state hazardous waste disposal and contamination sites throughout the United States.
