Kersten Kortbawi and Charles J. Vaccaro will present the live webinar “Setting the Standard in New Jersey: Good and Workmanlike Manner in the Construction Industry” on Wednesday, April 13, 2022 from 6:00pm – 7:00pm.  The program will be presented by the New Jersey Institute for Continuing Legal Education.

Workmanship issues are at the core of every construction project.  Every practitioner should understand the issues and potential claims stemming from the duties of good workmanship on construction projects.

This program will provide an in-depth review of workmanship issues and their impact on construction projects. After defining the principle of good workmanship, the presentation will focus on the legal sources of workmanship duties. These include express duties set forth in contracts, statutes, and regulations, as well as the duties implied as a matter of law. The speakers will also discuss the claims and dispute resolution process, the elements of causes of action for breaches of express and implied duties, and whether such claims should be resolved by arbitration or a court of law.

Ms. Kortbawi is a partner in the firm’s Litigation Department and a member of the Construction Disputes Practice Group.  She is an experienced commercial litigator who represents plaintiffs and defendants in all forms of civil litigation at both the state and federal level. Ms. Kortbawi frequently handles sensitive, unique, and high-exposure matters, including those related to complex construction disputes, consumer fraud claims, private equity fraud, personal injury actions, and product liability matters. In addition, Ms. Kortbawi provides business counseling, risk management and corporate advisory services to clients. Prior to commencing her legal practice, she served as the chief operating officer of a family-owned wholesale marine supply company for over a decade. 

Mr. Vaccaro is an associate in the Litigation Department and a member of the Construction Disputes Practice Group. His experience encompasses various areas of civil litigation at both the state and federal level, including contract and business disputes, employment law, insurance coverage, consumer fraud, real estate and personal injury matters.
